Synopsis: On 07/04/2013 at approximately 1900 hours, Deputies from the Mendocino County Sheriff’s Office conducted a traffic enforcement stop on a vehicle for equipment violations near the intersection of Kasten Street and Ukiah Street in Mendocino, California.

Upon contact, Deputies suspected that the driver, Jonathan Denver, was under the influence of alcohol with a blood alcohol content in excess of the legal limit allowed by law. Deputies summoned the assistance of the California Highway Patrol (CHP) and CHP Officers arrived and took over the investigation.

During that investigation, a passenger inside the vehicle, identified as Anthony Lowe, also exhibited signs and symptoms of alcohol intoxication and asked to leave the scene. Lowe was released and departed the scene but returned minutes later.

Lowe waited nearby while CHP Officers concluded their investigation and arrested Denver for driving under the influence of alcohol.

After Denver’s arrest, Lowe became irate and screamed obscenities towards officers at the scene and forcefully entered Denver’s vehicle to obtain personal property before leaving the scene.

As Lowe began to walk away, he turned and made an overt attempt to spit on a Deputy but missed. Based on Lowe’s exhibited behavior, coupled with his intoxicated state and his attempt to assault a law enforcement officer, Deputies informed Lowe that he was under arrest for public intoxication.

When Deputies approached Lowe to place him into custody, Lowe lunged towards a Deputy and had to be forcibly restrained.

As Lowe was being escorted to a prisoner transportation vehicle, Lowe made threats to inflict serious bodily injury on the transportation Deputy and made a failed attempt to assault that transportation Deputy.

Lowe, who was also on active summary probation, was ultimately transported to and booked into the Mendocino County Jail where he was to be held in lieu of $20,000.00 bail.
